I think some people have a misunderstanding about the weight limit

I think posters here are confusing contract law between individuals or parties with the officially commisioned law of legal bodies.


Actually its very similar to my war with private parking companies. You see they put up signs in carparks saying that park without a permit is subject to a £75 fine. However they DON'T have legal powers to make that a law, so even though they have said its £75 to park there, if you park there and they ticket you and you don't pay them they can't do shit, because they arn't the law. The only way they could get that money would be to prove in court that I had agreed to park there and to pay the £75 fine obviously impossible without a signature.

It's the same thing here. Manny and his team have NO legal power to change the welterweight limit to 145. The limit is still 147 and Cotto if he wished CAN weigh in at 147. Manny and his team can't stop him, they don't have the legal power. What would happen though, is that as Cotto has signed a contract to fight at 145 they would point out that he violated that contract (nothing to do with the WBO) and under the terms of that contract (which he HAS signed) then he would have to pay retribution to Manny according to whatever sums they agreed prior.

So you see, the agreement between Manny and Cotto is totally seperate from the WBO so it IS still a welterweight fight. Cotto CAN come in over the 145 limit if he doesn't care about breaking the contract and the WBO wouldn't cancel the fight because he hasn't violated their weight limit only the contractually agreed one. Then it would be up to Manny to either accept monetry compensation or else withdraw from the fight himself.

Basically it comes down to Cotto's choice. The weight limit is 147, and the WBO don't care one bit if Cotto weighs in at 147, the fight WOULD still go ahead, at least as far as the WBO were concerned. If Manny didn't want to fight HE would have to pull out.

So please realise its simply incorrect to say Miguel cannot weigh in at 147, or isn't allowed to weigh in at 147, because he IS. It's just that he has agreed a seperate, private contract with Manny that he will weigh no more than 145.

To be honest, from the point of view of that fans it's no more important than the split they are agreeing to or what gloves they are using. It's their contract, that they have agreed to, nothing whatsoever to do with us.

Good point you're making. Let's just say if Cotto decides to come in at 147, do you think Manny would still go on with the fight or pull out?

You can be assured that the fight won't be canceled because of a weight issue, Uncle Bobbie is there to think about it all and to make sure that everybody gets tons of money in the making.

The parking thing is interesting, here in the US, all they have to do is prove you were there and didn't follow whatever their code is (paying parking fee, having a pass etc. etc.) and voila you're sued for tresspassing. It's part of the private property rights we have here in our constitution.

I agree that the title itself is a seperate issue than everything that the fighters agree on. It is also the RIGHT of the sanctioning body to not allow the title to be on the line because of the contract between Cotto and PAC. Of course the WBO simply took this as "We'll let it go on for $400k instead of the normal sanctioning fee's because it is a special case and a cash cow fight"
