Im fucked, need serious advice
Ok, it was 6:30am on sunday morning and i was working in my little convience store called the Co-op.
I was really hungry and there was only me and my teamleader who was out in the back, so i decided to buy something from the shop and pay for it myself. (this is not allowed)
Ok so today i went into work and some professionals come in my shop and tell me to have an interview with them. K, they show me some photos of myself paying for the soda drink on the till that morning from CCTV cameras...now they tell me that the till that day was $70 down (basically it was short $70) and now it seems that im a key suspect (tills are actually down often). I have to have another meeting with the head of the company later next week and im not allowed to go into any of there stores and not allowed to work till the interview starts.
NOw, if i am proven guilty (I AM FUCK INNOCENT, I WOULDNT HAVE THE BALLS TO STEAL FROM THEM IN THE FIRST PLACE).....what will happen to me?
I know i have the risk of losing my job but what other consequences are there if the police become invovled?
Ps I am only 17

Re: Im fucked, need serious advice
Firstly mate - don't worry - if you are innocent they have to prove otherwise
secondly - you will just get a caution even if they did find you gulity (which they won't)
Don't let it get you down fella ;)
-
Re: Im fucked, need serious advice
mate it should really be up to them to prove your guilt and not for you to prove your innocence. ever heard the saying innocent till proven guilty. fuck em if they're gonna acuse you of that then tell em fuck off and get another job. if they have footage of you paying for your drink in the till they should have footage of you taking the money out. and if you didn't nick it then they obviously havent got the footage. tell em balls and be insulted by it. don't be scared of gettin in trouble ocs you havent done anything wrong.

if you get convicted, they will charge you with petty larsony (theft under $1000) and you will have a very hard time getting a job where you deal with money
get a lawyer NOW.............. sell something, ask to borrow money, do what you gotta do because the justice system in this country is a joke

What country is this taking place in and what is your race?

Re: Im fucked, need serious advice
i dont care if i lose my job, ill just get another one (the job's shite anyway)....what am i worried about is fees...last thing i need is a criminal record and a 2000 pound fine.
i wouldn't steal from my own fkin shop, it goes against my morals and i wouldn't risk taking a few quid just to get a criminal record.
I landed my ass in the fire because of one stupid mistake, dammit it looks so obvious its me but they couldnt be more wrong...
Im in england and im white, im 17 and have no history with crime

oh you're in england. If you were in america you could do one of two things:
1. be found not guilty
2. be found guilty and then appeal the ruling until they find you not guilty and call these dudes that erase your misdemeanor records.
Judging by the fact that people from england (wtf do you call people from england, britonians?) boo blair and some idiots over here still cheer for bush, i'm going to say that people over there aren't without reason.

Re: Im fucked, need serious advice
Don't worry about it fella and a criminal record is not the end of the World at all ;)
I work for massive US investment banks left right and Centre and none have ever checked on me before.
There is however a possibilty you'll end up in Nic with Mr Big rippin you a new A**hole over on B-Wing. ;D

Re: Im fucked, need serious advice
Seriously though im pretty experienced in matters with the filth ;)
If you get taken to the Police station DO NOT accept the duty solicitor they will offer you and try and get hold of a known Barrister/Solicitor from your area and Keep your f*cking mouth shut until you get one.
Use legal aid or you could end up owing a fortune in court fees if it goes tits up.
And seriously don't panic because a Criminal record means f*ck all unless your 'Legally Spent' and you don't even have to declare a Criminal record on a job application etc unless you have been (Legally Spent) ;)
It's a pretty minor offence and if it's your first then it's simply a slap on the wrist imo or if your Lucky you'll get community service (which is where you can make untold naughty contacts for the future)
;D

Re: Im fucked, need serious advice
i dont know if the police will be involved as they mentioned nothing about it...
I live in bournemouth
-
Re: Im fucked, need serious advice
Bit far for my Barrister ;D
Can't imagine in a million years it will go to court then and if it did it would only be at Magistrate level.
You may loose your Job but as far as prosecution goes your home and dry by a mile imo.
Seriously wouldn't worry about it mate.

Re: Im fucked, need serious advice
TheOne_77 - I run HR for quite a big UK company, here's my take on it (for what it's worth)
- The company has a problem with tills being down quite often. That means that someone else is probably stealing as common errors tend to cancel themselves out.
- you knew you should not have gone to the till and paid for your own food, so you seem to be definitely guilty of something. I bet the CCTV just shows you rummaging around in the till and isn't clear enough picture to see if you were putting stuff in or taking it out?
- Does the CCTV show you carrying the food you bought, or just standing rummaging in the till?
- contrary to popular belief, the company does not have to prove you're guilty or do anything 'beyond reasonable doubt'. UK employment law works on the 'reasonable balance of probability' so they just have to decide whether they believe you or not, and they can do what they like. If you have less than a year's continuous service you do not have any legal right to claim unfair dismissal or anything. If you have more than a year's service, they have to follow certain procedures if they want to sack you.
- The police, however, have to prove things beyond reasonable dounbt and unless they actually see you on CCTV taking money, they will not be interested in a prosecution.
To be honest mate, I think they may sack you just to send out a message to everyone else about nicking. We're all expendable as people so i wouldn't count on natural justice rearing its head!!!
When you have your meeting, see how you think it's going to pan out .... sorry to say, but if it looks like they are going to sack you, you may as well resign because they cannot say anything about the alleged nicking in a reference then!
I know it's hard, this sounds like one of your first jobs and then all this happens (assuming that you are innocent). I got sacked when I was 17 and it bothered me for ages. It's easy for me to say, but try not to let it get you down, mate. You are not losing a career or anything and and can get another job after.
I'm sorry if it seems all bad, but it's often better to think the worst so that anything good is then a bonus!!
BUT - if you have more than a year's service and you want some unofficial legal advice, pm me.
-

I couldnt give a dogs bullocks if i got the sack, the simple solution is just not mention it in my next job reference....

Re: Im fucked, need serious advice
Unless they've got you bang to rights on CCTV clearly nicking from the till, the police will not be interested.

ull be fine, i was a duty manager for the co-op for a few yrs - yeah what u did was wrong, but they can't and wont sack you for it, a written warning is the most they can do. Unless they see u taking the money from the CCTV they cant and wont sack you.
They will have to pay you your loss of earrnings to untill the let you work n the store again, so think of this as a free holl;)

Re: Im fucked, need serious advice
When they show you a tape of you stealing money then I'd panic. You broke a rule and that's all that tape shows you doing, right?
Denial is a powerful weapon. Don't admit to anything. Don't offer any information. Only confirm that you paid for your own snack.
Don't point the finger at anyone else or bring up names. Just say "I paid for my own snack."
-

Agreed. I'd find a new job regardless of what happens. If they let you keep your job they will force you to quite with unfair treatment. Bullshit hours. Assign you the worst job in the place every day you work.
Move on.

i dont believe it, duty manager of the Co-op...where u from friend?
Thank you for the advice, it really takes a weight of my shoulders...
But yes i will be resigninging from the Co-op once this is over, because when i return to work again it probably wont be the same. They'll probably look at me as if i'm distrustful and the first thing i was from a job is too be respected.

Re: Im fucked, need serious advice
Part of me personally would want to prove the point and make them drag out every fucking CCTV tape, cross reference shifts and go over the tills just to kind of show that I'd nothing to hide.
Ultimately you've gone against company policy by buying the drink but your certainly not guilty of helping yourself to £70 from the till. They can't prove it cos it didn't happen but your quite right, that element of doubt will still be there.
As far as references go...you'd be surprised at just how sloppy at lot of companies are. At your age just bang on a couple of personal references if asked. If you really must declare that you've worked at this shop (to prove you have relevant experience for example) they can only put in your reference statements of fact. Most companies only put dates of employment on these days cos they're afraid of getting sued.
-
Re: Im fucked, need serious advice
Turn the shit around on them. Get a lawyer and sue the fuckin company for slander and causing you emotional grief. Your a kid with no record and there's no tape (there ain't right) or proof that says you did it. Being named as a suspect has caused you severe stress. I guarantee you they'll back off.

this is the uk, not being funny but in the us u can sue people for looking at u funny, fk a women sued Mc donalds coz thier coffe was to hot ffs
As for your references, not to worry, it is illegal for any employer to give u a bad one, they can only A acnolage the fact that you worked for them from date said to date said, or B only list the good points, anything bad and you can press charges and win without a doubt.

If they dismissed him for theft (rightly or wrongly), they can say they dismissed him for theft.
It is not illegal to give a bad reference, it is illegal to give an UNTRUE one.

what im worried about is:
I put $20 in the till for the drink and i got my change of $19.37, that could look like anything from a CCTV point of view. Because the change was pretty vast it is almost impossible to tell what the hell i did take

Haven't read through all of this yet BUT if you accept a caution you are admitting guilt. So don't.

Bang on... they can not accuse you of taking money if they do not have 100% proof you could get a tidy sum for this if you turned the tables on them...
also im 99% sure photographic evidence does not stand up in court or never used to ;)
so they can do fuck all if you took it or not... which im betting you did you theiving bastard ;D
anyhoooo dont worry they cant do fuck all except make you so shit scared that you wont do it again which is what it sounds like they are doing ;)

Re: Im fucked, need serious advice
Sue them and then get 1 million dollars. Then go talk to your employers and go well thanks for the 1 000 070 bucks ;D
