Yes it was unfair dismissal and since he has worked there 5 years he has the right to go to an employment tribunal as they have not followed the disciplinary procedures. The waltz is just a red herring this is grossly unfair and should be taken seriously.

That was kind of brilliant, I was so ready to reply that I knew somebody who got fired for exactly the same reason
