when the ref waved which could have been 9 and a half and not 10 he still wasnt totally up

if hed have been half way up at 9 and a half and telling the ref he wanted to go on and looking enthusiastic id have said it was very harsh
I'm not going to split hairs here. The man was up and upright with no wobbling at all at 9. Could have been 9.2 or 8.9

Many of these same refs will actually do a full ten count when a guy is planked and out cold. Why is that? Reffing needs an over haul as much as anything. Scott got stiffed and whether he would have won or Chisora was coming on is not relevant really. You could even tell by the refs face that he blew it.
