A big part of getting MMA legal in the U.S. was the implementation of a universal set of rules. To appease the state licensing bodies the rule of no knees or kicks to the head of a downed fighter was added. Downed fighter being at a minimum of a knee on the mat. Clearly some fighters take advantage of it and it is widely considered a rule that should be changed but I don't think its something that is actually going to happen. I always found it interesting that Pride allowed kicks and knees to the head of a "downed" fighter but no elbow strikes.
