Ironically enough the only one under criminal investigation is the officer as all charges were dropped against the man. I know California has some screwed up roadways and traffic-pedestrian laws but really, how is this even considered jaywalking. Stopping, yield right of way and crossing strictly from corner to corner seems pretty basic. No traffic signals at all. The jaywalking is simply a default cause to stop and question a 'suspicious' person here. He never identified himself and likewise never asked him to produce identification. And how common is it to radio for back up prior to stopping a jaywalkerHe might have been calling in a stop but it's not clear. At no time can you hear the guy 'curse' the officer over all of the radio chatter in the car. The cop lost total control of the situation and was also po'd at his Aunt yelling to him from the car and went from 0-60 because a citizen rightfully questioned him on what grounds he was being stopped and pleaded his innocence. This isn't a left or right thing, it's an abuse of power thing. When your own Department is already inferring you were out of line and it's against policy there really is no defense. This kid will get a nice chunk of change at the end of the day.
